Child support in the state of Texas is determined by a very exact and specific formula, as laid out in the Texas Family Code. The formula itself is based on the paying parent's net resources and the number of children from the marriage. There are situations where it is appropriate to deviate from the formula set out in the Texas Family Code. Which parent will be responsible for paying child support is determined either through a mutually agreed-upon decision or through a decision handed down by the court.
In this day and age, neither parent will be automatically granted custody of their children in a divorce. Both mothers and fathers have equal rights to their children.
